Germany's §18a and §18b Skilled-Worker Route When the Blue Card Does Not Fit

Germany's skilled-worker residence route can be the right alternative when an offer does not meet EU Blue Card conditions, but it is not a renamed Blue Card application. The file must independently prove a recognized or comparable qualification, a specific qualified job, acceptable employment conditions, and Federal Employment Agency approval where required.

Use the route that matches the facts

Sections 18a and 18b cover qualified professionals with vocational training or academic qualifications. The official work visa for qualified professionals says the qualification must be recognized in Germany or comparable to a German academic qualification, the applicant needs a specific offer for qualified employment, and auxiliary tasks are insufficient. A professional license is required for a regulated profession.

The EU Blue Card uses its own qualification, job-match, contract-duration, and current salary conditions. Use the separate 2026 Blue Card threshold guide if that is the actual decision. If salary misses the Blue Card threshold, do not assume §18a/§18b automatically succeeds.

Salary still matters without a Blue Card threshold

For the qualified-professional route, the Federal Employment Agency generally assesses whether salary, hours, and other conditions correspond to those offered to domestic employees. Build a short employment-conditions memo showing guaranteed gross pay, weekly hours, contract term, work location, collective-agreement classification or internal comparator, and how variable compensation is treated.

Make the qualification and job reviewable

Do not leave the authority to infer fit from a CV. Pair each material duty with the qualification, module, certification, or experience that supports it. The contract, employer declaration, job description, and any annex must agree on employer entity, title, salary, hours, location, start date, and duration.

The official page now says the job need not be related to the qualification, although it must be qualified employment. That corrects the older draft's overbroad claim that the job always had to correspond directly to the qualification. Regulated professions remain an important exception because a license to practice is still needed.

If a Blue Card application has already failed

Read the exact refusal or request. A salary-threshold defect, missing recognition evidence, weak job description, or inconsistent form requires a different repair. Preserve the appeal deadline while deciding whether to correct the Blue Card, respond within the existing case, or file a skilled-worker application. Do not let an employer's informal promise replace a signed annex or official route analysis.
