Portugal D8 Remote-Work Route: Requirements, Visa, and AIMA Sequence
Portugal's remote-work residence route is a fit only when a non-EU employee or independent professional works remotely for a person or entity outside Portugal and can document the required recent professional income. For applications using the 2026 continental minimum wage, four times €920 is €3,680 a month. If the work is for a Portuguese employer, the income is not traceable to the qualifying activity, or the serving post will not accept the file, stop and identify the correct route before paying or moving.
“D8” is useful shorthand, not the name used in the legislation. This guide covers the residence visa for remote professional activity outside Portugal and its handoff to a residence application. It does not cover the separate temporary-stay visa.
Pass the work-definition gate
Portugal's official consolidated foreigners law defines the remote-work route for subordinate or independent activity performed for a person or entity outside Portugal. The consolidated implementing regulation supplies the evidence alternatives for the residence route. Use those consolidated texts for the current route definition and evidence alternatives, then check the serving post's current intake instructions.
| Applicant's real working relationship | Route-specific evidence | Stop condition |
|---|---|---|
| Employee of a foreign organization | Employment contract or employer declaration proving the relationship | Stop if the employer will not confirm that the work can be performed from Portugal, or if the real job is with a Portuguese employer. |
| Independent professional serving foreign clients | Company agreement, services contract, or evidence of services supplied to one or more entities | Stop if the file shows only savings, company turnover, or a business registration without the applicant's qualifying work and income. |
| Owner working through a company | The applicable independent-professional document plus a traceable personal work-and-payment record | Stop if the company story does not show who does the work, who pays whom, and which receipts belong to the applicant. |
Use one coherent account. Do not combine an employee contract, unrelated invoices, and company revenue merely to fill document slots.
Calculate the 2026 income test correctly
Article 31-A of the implementing regulation asks for average monthly income from the qualifying subordinate or independent activity during the last three months equal to at least four guaranteed minimum monthly wages. The static official 2026 wage decree sets the guaranteed minimum monthly remuneration for continental Portugal at €920 from 1 January 2026:
4 × €920 = €3,680 per month.
This is a three-month average of qualifying professional income, not a minimum bank balance. Reconcile each month across the contract, payslip or invoice, bank receipt, payer name, and any currency conversion. Explain bonuses, late invoices, owner draws, or irregular deposits instead of assuming a reviewer will reconstruct them.
The €920 decree has a continental territorial scope. Treat €3,680 as the documented mainland working figure, not as authority to override a written instruction from the post handling an application connected with an autonomous region.
Build the consular file from the serving post
An inspectable two-page remote-work residence checklist from Portugal's Consulate-General in Maputo contains the route-specific documents above and a general core: signed national-visa form, photographs, passport and copy, proof of lawful status when applying outside one's country of nationality, travel insurance, and the applicable criminal-record certificate. It also repeats the three-month/four-wage test and tax-residence evidence.
That PDF was accessible on 7 August 2026, but it displays no issue date and belongs to the Maputo post. It is evidence of the national core, not permission to use Maputo's intake rules in another jurisdiction. Obtain the current checklist from the Portuguese post serving the applicant's lawful residence and resolve these fields before booking:
- which post or external provider has jurisdiction;
- whether accommodation, return travel, or extra means evidence is requested;
- translation, apostille or legalization rules for each civil and criminal record;
- accepted insurance wording and dates;
- appointment method, originals and copies, fee, payment method, and passport return; and
- a separate legal basis and document list for every accompanying family member.
Do not promise that family requests will be handled together. Family eligibility, timing, appointments, and residence basis must be checked in the current consolidated foreigners law and with the receiving authority for the actual sponsor and family member.
Keep the visa and residence stages separate
| Stage | What the inspectable authorities support | What to retain or verify |
|---|---|---|
| 1. Route and evidence | Foreign remote work, the employee/independent document alternative, the last-three-month four-wage average, and tax-residence evidence | A one-page fact map linking the payer, contract, work location, three income months, and tax residence. |
| 2. Consular application | The serving post takes the national residence-visa file; local intake details are jurisdiction-specific | The exact serving-post checklist, appointment confirmation, complete submitted file, and receipt. |
| 3. Residence visa | The 2022 law text states that a residence visa is an entry instrument for requesting residence authorization, valid for two entries and a four-month stay | Read the issued visa itself, preserve a copy and entry evidence, and calculate the deadline from the visa rather than from an article or adviser summary. |
| 4. Residence application | The static 2024 regulation amendment assigns residence grants and renewals to AIMA and lists general residence-file information such as identity, means, accommodation, Portuguese criminal-record information, and, where applicable, tax and social-security registration | Verify the current AIMA channel, appointment, fee, purpose-specific documents, and any documents that must be refreshed. Keep the submission record and decision. |
Law 61/2025 identifies the provisions it changed; articles 58 and 61-B are not in that amendment list, while current consular material continues to present the remote residence route and the two-entry/four-month residence-visa structure. Use that sequence for planning, but read the issued visa and obtain the serving post's current instruction before calculating any deadline.
No title-validity period, renewal interval, AIMA fee, appointment channel, or processing time is asserted here. Those details are easy to copy from stale pages and are not necessary to decide route fit or prepare a traceable handoff.
Keep immigration separate from tax, payroll, and company risk
A NIF, NISS, company registration, or bank account does not prove remote-work-route eligibility. A visa or residence decision also does not settle tax residence, employer payroll, labor law, social security, permanent-establishment exposure, or the host-country position of an independent business. Obtain written employer or client approval for work from Portugal and analyze those questions separately.
The file is ready to submit only when another person can trace the foreign work relationship, each of the three income months, tax residence, consular jurisdiction, issued-visa deadline, and visa-to-AIMA handoff without filling a gap by inference.
