Spain Freelance Visa Requirements: Cuenta Propia and Digital Nomad Routes
Spain does not have one legal route simply called a “freelance visa.” A non-EU national planning self-employed work must first distinguish the ordinary residence and work authorisation for cuenta propia from the international teleworker route commonly marketed as the digital nomad visa. The first is built around carrying on the proposed self-employed activity in Spain; the second is built around remote work for businesses or clients outside Spain.
The international teleworker route also covers foreign employees, who are not freelancers. Include the employee branch when choosing the correct digital-nomad route, but do not collapse employee telework into ordinary self-employment.
Choose the route from the real business model
| Actual work model | Route to test | Deciding boundary |
|---|---|---|
| Local shop, clinic, trade, studio, regulated profession, or service business based mainly in Spain | Ordinary cuenta propia | Prove the activity can lawfully operate, the required qualification or licence, and sufficient planned investment |
| Self-employed professional working remotely mainly for businesses outside Spain | International teleworker — professional branch | Prove the qualifying foreign client relationship and keep Spanish professional activity within the statutory limit |
| Employee of a company outside Spain working remotely from Spain | International teleworker — employee branch | The employment must remain with the foreign company; this is not a freelance or Spanish-employer route |
| Employee hired by a Spanish employer | Ordinary employment route | Do not relabel a Spanish job as cuenta propia or international telework |
Choose the row before collecting documents. A business plan for a local Spanish activity does not prove a qualifying foreign telework relationship, and foreign-client invoices do not replace the ordinary cuenta-propia licensing and investment analysis.
Ordinary cuenta propia: the freelance route for a Spanish activity
The Ministry's Hoja 14 describes an initial temporary residence and work authorisation for a non-EU national who is not resident in Spain and intends to carry on a gainful self-employed activity. Under Articles 82 to 85 of Royal Decree 1155/2024, the initial authorisation lasts one year and is limited to an autonomous-community area and sector of activity.
The project file must establish, as applicable:
- compliance with the rules nationals must meet to open and operate the proposed activity;
- legally required professional qualification, experience, recognition, or professional-body membership;
- sufficient planned investment and its effect, including self-employment and any job creation;
- the general residence and public-order requirements;
- the current application form, fees, translations, and legalisation controls; and
- the post-entry Social Security registration that makes the initial authorisation effective.
Build a business evidence table with the exact activity, location, sector, required licences or prior notices, qualification, investment amount and source, operating costs, clients, pricing assumptions, and Social Security start. Do not use the 200% SMI teleworker threshold below as a substitute for the ordinary route's project and investment test.
Spain digital nomad visa requirements for 2026
Spain's digital nomad route is formally the international teleworker route. It is for a non-EU national who works remotely from Spain for a company or clients established outside Spain using computer and telecommunications systems. An employee may work only for companies outside Spain; a self-employed professional may perform work for Spanish companies only when that Spanish activity does not exceed 20% of total professional activity.
For a 2026 application, prove five things as one coherent file: a qualifying foreign work relationship, a business that has operated for at least one year, at least three months of prior relationship with that business or clients, suitable qualification or experience, and sufficient resources and coverage for the applicant and family.
2026 income requirement
The official UGE evidence sheet sets the principal applicant's resources at 200% of the current minimum interprofessional wage (SMI). Spain's Royal Decree 126/2026 fixes the SMI at €1,221 per payment and at least €17,094 annually. Keep the payment frequency visible: €1,221 × 14 equals €17,094. The percentage calculations below use that 14-payment basis, not twelve calendar-month payments:
| Household member | Official percentage | 2026 amount per payment (14-payment basis) |
|---|---|---|
| Principal teleworker | 200% of SMI | €2,442 |
| First accompanying family member | 75% of SMI | €915.75 |
| Each additional family member | 25% of SMI | €305.25 |
These are gross resource amounts before deductions. For the principal alone, €2,442 × 14 is €34,188 a year, equivalent to €2,849 per calendar month over twelve months. For a principal applicant, partner and one child, the combined 300% calculation is €3,663 × 14 = €51,282 annually, or €4,273.50 per calendar month. These are arithmetic equivalents: reconcile your actual payment schedule with the receiving authority's evidence requirements.
The calculation combines the UGE percentages with the official 2026 annual SMI and shows both payment schedules. The official Argentina consular guidance expresses the principal's amount as €2,442 over fourteen payments; do not read that as €2,442 paid only twelve times. Before filing, reopen both the UGE teleworker evidence sheet and Royal Decree 126/2026. Do not reuse a 2025 euro figure or treat net bank receipts as automatically equivalent to the stated gross test.
Employee or professional telework relationship
The file changes with the work model.
Foreign employee
Show a genuine employment relationship with a company outside Spain, including:
- contract and employer certificate;
- at least three months of prior employment or professional relationship;
- express permission to work remotely from Spain;
- role, duties, pay, hours, and intended remote-work period; and
- registry evidence that the foreign company has operated for at least one year.
An employee on this route cannot add a Spanish employer to the file.
Self-employed professional
Show foreign client or company relationships, remote suitability, and the revenue split:
- contracts identifying services, term, and payment;
- invoices and matching bank receipts;
- at least three months of prior professional relationship;
- registry or equivalent evidence that the qualifying business has operated for at least one year;
- a client matrix separating foreign and Spanish activity; and
- a defensible calculation showing Spanish professional activity does not exceed 20% of total activity.
The 20% rule is an immigration condition for professional teleworkers. It does not answer VAT, income-source, tax-residence, or permanent-establishment questions.
Qualification and experience
UGE's official evidence sheet accepts a degree from a recognised university, vocational-training institution, or recognised business school, or evidence of at least three years of professional experience comparable to the work to be performed. For a regulated profession, resolve recognition or homologation before assuming the remote-work authorisation permits practice.
Connect the degree or experience evidence to the actual duties. A diploma with no job-fit explanation, or generic experience letters without dates and functions, leaves the caseworker to reconstruct the case.
Social security and health coverage
Immigration permission, social-security coverage, and health insurance are separate but connected requirements.
The filing should establish either the applicable Spanish registration path or valid imported coverage under an international social-security agreement, supported by the competent institution's certificate for the actual telework relationship. Not every country issues an applicable teleworker certificate. A private letter from the employer does not replace a competent-institution decision.
The consolidated Spanish law also requires public insurance or private health insurance contracted with an insurer authorised to operate in Spain. Confirm the receiving authority's current wording, territory, duration, and benefit requirements before buying a policy. Do not assume travel insurance, an employer benefit card, or a foreign policy satisfies the residence route.
For each applicant, retain:
- the applicable-system decision or registration evidence;
- coverage start date and intended work start;
- the issued health-insurance certificate and full terms; and
- any authority confirmation relied on for foreign coverage.
Criminal, identity, and document controls
Build the controlled file from the consolidated statute, UGE's teleworker page, and its evidence sheet. It includes identity, work and company documents, resources, insurance and social-security proof, qualifications, and criminal-record evidence within the statutory framework. Confirm intake mechanics—form, fee, appointment, copies, and delivery—with the competent receiving authority; do not use an inaccessible consular checklist as the substantive basis for a requirement.
Foreign public documents may need an Apostille or legalisation and an official Spanish translation. Names, passport numbers, company names, contract dates, and household relationships must agree across every document. Record the issue date and expiry or acceptance window for time-sensitive certificates.
Visa abroad or residence authorisation in Spain
Use the filing channel that matches the applicant's location and legal stay:
- Digital nomad visa: normally filed through the competent Spanish consulate for entry and residence.
- International teleworker residence authorisation: handled by UGE for an eligible applicant using the residence-authorisation procedure, including a person lawfully in Spain who qualifies to file there.
Do not assume that visa-free presence cures an overstay or guarantees in-country eligibility. Confirm jurisdiction, legal-stay evidence, appointment or online channel, and family filing method with the receiving authority before paying fees or allowing documents to expire.
Build the financial evidence
The official UGE sheet points to recent payslips or invoices and supporting contracts as resource evidence. Make the numbers reproducible:
- List the principal and accompanying family members.
- Calculate the applicable 200% + 75% + 25% resource test using the current SMI, then reconcile the annual total and payment frequency.
- Show at least the requested evidence period with gross amounts, currency, and payment dates.
- Reconcile payslips or invoices to bank receipts.
- Explain variable income, gaps, bonuses, exchange rates, or contract end dates.
- Show that the qualifying relationship and resources continue for the proposed stay.
Savings may support the file only to the extent accepted by the receiving authority. Do not substitute an unexplained account balance for the underlying lawful and available source of funds.
Family applications
Eligible accompanying family can include a spouse or partner, dependent children, and dependent ascendants within the statutory conditions. Prove the relationship, dependency where relevant, resources, insurance, and any required criminal or civil-status documents for each person.
Use one household control table:
| Person | Relationship proof | Resource addition | Insurance | Criminal/civil documents | Translation/legalisation |
|---|---|---|---|---|---|
| Principal | — | 200% of SMI; reconcile the annual total | Required route proof | Applicant set | Check |
| First family member | Marriage, partnership, birth, or dependency proof | 75% of SMI; reconcile the annual total | Individual proof | Person-specific set | Check |
| Each additional member | Person-specific relationship/dependency proof | 25% of SMI; reconcile the annual total | Individual proof | Person-specific set | Check |
The euro amounts above use the 2026 SMI and must be recalculated if the SMI or official methodology changes.
Keep ordinary cuenta propia and telework files separate
Use ordinary cuenta propia when the real plan is a local shop, clinic, trade, studio, or mainly Spanish-client business. Use an employment route when a Spanish employer will direct the work. Do not distort contracts or revenue geography to fit the digital nomad label.
Conversely, do not send a qualifying international teleworker only through the ordinary route because the applicant invoices rather than receives payroll. The professional teleworker branch is expressly self-employed; its foreign-relationship, remote-work, and 20% tests remain different from the ordinary project test.
For a cross-country screen, compare the European digital-nomad visa routes. Tax residence and invoice treatment remain separate; use the Spain non-resident tax guide only for issue spotting.
Final route-specific readiness check
For ordinary cuenta propia, do not file until the legal activity, qualification or licence, investment, business evidence, consular procedure, and Social Security activation sequence agree. For international telework, do not file until the foreign work relationship, one-year business history, three-month prior relationship, qualification or experience, 2026 resource calculation, social-security position, health coverage, identity and criminal records, translations, and filing jurisdiction point to the same facts. Save the official pages and evidence sheet used on the filing date.
Correction — October 15, 2026: The income examples now distinguish fourteen wage payments from twelve calendar months. The earlier €2,442 principal and €3,663 three-person figures were labelled monthly without that distinction; their twelve-month equivalents are €2,849 and €4,273.50 respectively.
