Buying Property in Hungary as a Foreigner: Government Permission, 4% Duty and Land-Registry Control

Foreign-buyer rules in Hungary depend heavily on nationality and property type. EU and EEA buyers generally have a simpler route for ordinary non-agricultural property. A non-EU buyer commonly needs permission from the capital or county government office for the specific acquisition.

Agricultural and forestry land follows a separate, much stricter regime. A city apartment is not a precedent for buying a vineyard, farm or rural parcel.

Property ownership is not a Hungarian residence permit. Hungary's current guest-investor route is based on specified investments such as qualifying fund units or a large donation, not ordinary home ownership.

Determine whether permission is required before signing unconditionally

The current government regulation on foreign acquisition of non-agricultural property applies to foreign natural and legal persons within its scope.

The buyer will commonly need government-office permission. The lawyer should file a property-specific application, verify the condominium and land register, and make the contract conditional enough to protect the deposit. The mortgage file will need translated US income and tax evidence.
